Dear Sirs,
We are Members of Americans Against Foreclosures ( AAF ) in Florida.
We have received a copy of the attached order you sent one of our Members, and pursuant to RESPA, and we would like to confirm the following with you:
1.) That you in fact represent the Plaintiff Washington Mutual Asset-Backed Certificates, WMABS Series 2006-HE3 Trust which filed the complaint to foreclose on March 28, 2016?
2.) That according to Section 19 of the Mortgage Agreement the Borrower can now request to Reinstate the Loan After Acceleration, although they have not received the agreed Notice of Acceleration?
3.) That according to Section 22 of the Mortgage Agreement the Lender Direct Capital Corporation did not notify Borrowers of their rights to modify the loan, and would now like to file a request to do so.
4.) That according to Section 25 the Borrowers feel that being obligated to waive their constitutional right to a Jury Trial has violated their due process seventh amendment rights and would like to discuss this issue with you.
5.) That according to number 3 of the Complaint filed Plaintiff alleged that it is in possession of the original note, but there is no evidence of this in the complaint, and when can the Borrowers inspect the original note?
6.) That according to number 6 of the Complaint Plaintiff states that the Defendants are in default, but we do not see any loan history or accounting to support this statement?
7.) That according to number 10 of the Complaint there is an amount stated, but no payment history nor accounting documents to support it?
8.) That there is no evidence of a power of attorney ( POA ) in the file regarding your firm? Please let us know when we can speak with you about the above? Do you require a letter of authorization to speak with us?
