AXJ Members in Florida have requested that we create this page to discuss wrongful foreclosures in Florida.
Taking into consideration the fact that Florida is a judicial State, and in part based on Roman Law inherited from the Spanish Civil Code, this provides homeowners with more legal protections than in non-judicial states. What does this mean? Basically that the foreclosing party has the burn of proof and must file a complaint in order to begin the foreclosure process.
Once the complaint is filed, they must legally serve the complaint on you along with a copy of the Summons to appear in Court. From that moment on you have 20 days to reply to the complaint.
